RE: The tariff classification of cleaning cloth from Canada

Dear Mr. Walter:

In your letter dated April 22, 2010 you requested a classification ruling on behalf of Quebec Inc. dba Micro Clair International Inc.

The submitted sample is a cell phone lens cleaning cloth. The cloth is made from a man-made fiber woven fabric laminated to plastic. The cloth measures approximately 1 inch square and has rounded corners. The cloth will be used to clean the LCD screen on cell phones and iPod’s.

You suggest classification of the cloth under subheading 5903.20.2000, HTSUS. However, the cloth is considered to be a made up textile article per Section XI, Note 7 as it has been cut to a shape other than a square or rectangle (i.e. rounded edges).

The applicable subheading for the cloth will be 6307.10.2030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up articles, including dress patterns: floorcloths, dishcloths, dusters and similar cleaning cloths: other… other. The general rate of duty will be 5.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
